PRIVACY POLICY

The Wee Letting Agency Trading as Minty Estates Data Subject Rights Sheet and Privacy Policy.

Data Subject Rights:

1.Request access to your personal data.

2. Should you make a subject access request to obtain information about your data we:

  • have 31 days to respond to your request. Should this not be possible, we can ask you for an extension of time which should not be unreasonably withheld; although we genuinely propose to respond within the time limit set.
  • Although we are not allowed to charge fees for initial copy documents provided; due to the fact that it is the policy of this company to provide clients with most of their file Immediately a second request for documents we have already provided may attract a fee.
  • We will ask our clients to keep all documents and letters sent in an orderly manner.
  • You are legally entitled to an electrical copy of your file. We will ask you for an encrypted USB to put your data on or we will email to you using a secure transfer.
  • GDPR does allow charges for additional copying.

3.Subject access request

You have the legal right to make a subject access request for your data. This has always been the case before GDPR. We will comply with your request. However, it is likely as a client you would practically have your whole file any way, prior to the request.

Prior to GDPR and after its implementation, we have always been very transparent with clients.

4.How we process data

We process data when we initially communicate with landlords or vendor to discuss the marketing of their property for sale or lettings. This is known as the first steps, we will confirm your consent at this stage in order to proceed with your initial enquiry.

We process data when we register applicants who have enquired about an available property to rent or buy. Along with questions to identify the applicant, we ask question around income, employment, lifestyle and deposits, we have to ask these questions as part of our vetting process, this avoids problems developing later after commitments by applicants have been made to proceed with property renting or purchases. We will confirm your consent at this stage in order to proceed with your initial enquiry.

Your data is stored on TWLA computers in a secure premises, we typically will have some documents stored as hard copies. Your data it is currently physically backed up to a protected hard drive. Your data is not currently stored on the cloud. We will very soon move to cloud based storage but we have delayed this to ensure compliance with GDPR.

There is risk that your data may be lost If the computer or hard drive becomes damaged and / or malfunctions.

We also process data on the basis of the contract we arranged for you or have with you. It is our understanding of the rules that the contract gives us a right to process your data because it is necessary to fulfill our contractual obligation to you.

We also will retain data for 6 years. This is a legal requirement and again this is a lawful basis for us processing your data.

Depending on what we do for you, we may have to give your data to tenant referencing companies (Homelet and Alan Boswell), maintenance and building contractors (Essar property services, Morley Alexander Heating and Plumbing Engineers, inventory clerks (Inventory Worx), utility companies, telecommunications companies, service providing companies (British Gas), debt collection companies, conveyancing solicitors (Beverley Morris & Co. and Anthony Leonard Associates) and surveyors (Edward James Surveyors LTD).

Our service providers may change,updated details will be supplied. Clients are always informed and will make the necessary consent for their data to be processed in this way.

Unlike other industries, I cannot delete any data before 6 years. We only use your date for the purposes specified within your enquiry or for the purposes specified within your contract, we will on occasion contact clients to discuss service available but only with your additional consent. We do not give your data to third parties that are not involved in the supply or the service that is required to be provided to you.

5. Third Parties

We are obliged to put in place contracts with third parties and/carry out due diligence.

We have carried out due diligence in relation to some suppliers.

We have and will put contracts in place with third party suppliers on a needs basis.

6.Breaches

We have a system in place for data protection breaches. The only real breaches we for see is accidental loss or damage of data. Our data is backed up. Also emailing to a wrong party. We usually will notify clients straight away if this is done and ask the wrong recipient to delete the information.
